Authority: The authority for this rule is
granted to the Director of the Department of Corrections in
accordance with ORS 179.Policy: It is the policy of the Department
of Corrections to establish procedures to provide for the best
possible evaluation, treatment and return or release to inmates, to
and from a state mental hospital in accordance with ORS 179.Unable to provide for basic personal needs
and is not receiving such care as is necessary for health or safety.A) Is chronically mentally ill, as defined in
ORS 426.State Mental Hospital: As defined in ORS
426.Inmates in OYA physical
custody will be transferred directly from an OYA facility to a state
mental hospital listed in ORS 426.The hearing shall be conducted by an
independent hearings officer.The hearings officer may pose questions
during the hearing.When confidential informant testimony is
submitted to the hearings officer, the identity of the informant and
the verbatim statement of the informant shall be revealed to the
hearings officer in writing, but shall remain confidential.The hearings officer may
postpone the rendering of a decision for a reasonable period of time,
not to exceed three working days from the date of hearing, for the
purpose of reviewing the evidence.Be present at all stages of the hearing
process, except when the hearings officer finds that to have the
inmate present would present an immediate threat to facility security
or safety of its staff or others.The reason(s) for the finding shall
be part of the record.An inmate subject to an administrative commitment hearing
may not receive assistance from another inmate.The inmate shall be given written notice
that an administrative commitment to a state mental hospital listed
in ORS 426.Department
of Human Services, or an extension of the transfer is being
considered by the Department of Corrections and the Department of
Human Services.The notice will be provided by the hearings
officer.Such notice must be provided far enough in advance of the
hearing to permit the inmate to prepare for the hearing, but in no
case shall notice be provided less than 24 hours prior to the
hearing.The notice shall include a copy of this
rule.An investigation shall be conducted upon
the inmate's request, if an investigation will assist in the
resolution of the proceedings and the information sought is within
the ability of the facility to procure or the inmate to provide with
his or her own resources.The hearings officer shall allow the inmate
access to the results of the investigation unless disclosure of the
investigative results would constitute a threat to the safety and
security of the facility, its staff or others, or to the orderly
operation of the facility.The reporting employee or other agents of
the Department of Corrections or Department of Human Services who are
knowledgeable may submit to the hearings officer documents or reports
in advance of the hearing that are being relied upon for the
administrative commitment or extension of the transfer.Such evidence
must be disclosed to the inmate during the hearing.The reason(s) for exclusion shall be made part of the
record.Notwithstanding subsection (2) of this
rule, the hearings officer may classify documents or other evidence
as confidential, and not disclose such evidence to the inmate, upon
finding that disclosure of psychiatric or psychological information
would constitute a danger to another individual, compromise the
privacy of a confidential source, or would constitute an immediate
and grave detriment to the treatment of the individual, if medically
contraindicated by the treating physician or a licensed health care
professional in the written account of the inmate.The reason(s) for
classifying documents or other evidence as confidential shall be made
part of the record.The hearings officer shall direct the
scheduling and taking of testimony of witnesses at the hearing.Witnesses may include inmates, employees, or other persons.Good cause includes, but is not
limited to, an undue risk to the safety, security, or orderly
operation of the facility or an immediate and grave detriment to the
treatment of the individual due to disclosure of psychiatric or
psychological information, if medically contraindicated by the
treating physician or a licensed health care professional.The hearings officer may limit testimony
when it is cumulative or irrelevant.The reason(s) for not posing a question will be made
part of the record.The hearings officer may, on his or her own
motion, call witnesses to testify.If a witness is
excluded, the reason(s) shall be made part of the record.Persons other than staff requested as
witnesses may refuse to appear or testify.The reason(s) for the postponement shall be
made part of the record.The findings
must be on the merits.Technical or clerical errors in the writing or
processing of the transfer request, or both, shall not be grounds for
a no justification finding, unless there is substantial prejudice to
the inmate.Facts, Conclusions, and
Recommendation" of the hearings officer.Oregon
State Hospital items (a), (b), (d), and (e) of this section.Reopen the hearing for the introduction and
consideration of additional evidence.Oregon State Hospital reopens the hearing under this rule, the
hearings officer shall, pursuant to these rules, conduct the reopened
hearing and prepare an amended hearing record within three days of
the reopened hearing.If the Department of Human Services
determines that the administrative commitment must exceed 180 days in
order to stabilize the inmate, the administrative commitment must be
renewed in a subsequent administrative commitment hearing held in
accordance with these rules.Notwithstanding this rule, an
administrative commitment may not continue beyond the term of
incarceration to which the inmate was sentenced.When an inmate is transferred to a state
mental hospital, the Department of Corrections shall send a check for
the balance of the inmate's account to the business office of the
state mental hospital.When an inmate is transferred to a state
mental hospital, the Department of Corrections facility shall provide
a copy of the inmate's approved list of visitors.Reporting of unusual incidents involving
inmates administratively transferred to a state mental hospital shall
be handled in accordance with the Department of Corrections policy on
Unusual Incident Reporting Process.Department of Human Services records and
information shall be handled in accordance with ORS 179.Any discrepancies with the
published version are satisfied in favor of the Administrative Order.Numerical

So when you meet in battle those who disbelieve, then
smite the necks until when you have overcome them, then make
(them) prisoners, and afterwards either set them free as a
favor or let them ransom (themselves) until the war
terminates.Allah, He will by no means
allow their deeds to perish.SHAKIR:
And cause them to enter the garden which He has made
known to them.If ye will aid (the cause of) Allah, He will
aid you, and plant your feet firmly.PICKTHAL:
O ye who believe!If ye help Allah, He will help you and will
make your foothold firm.SHAKIR:
O you who believe !Allah, He
will help you and make firm your feet.SHAKIR:
And (as for) those who disbelieve, for them is
destruction and He has made their deeds ineffective.PICKTHAL:
That is because they are averse to that which Allah hath
revealed, therefor maketh He their actions fruitless.SHAKIR:
That is because they hated what Allah revealed, so He
rendered their deeds null.PICKTHAL:
Have they not travelled in the land to see the nature of the
consequence for those who were before them?YUSUFALI:
That is because Allah is the Protector of those who believe, but
those who reject Allah have no protector.PICKTHAL:
That is because Allah is patron of those who believe, and
because the disbelievers have no patron.SHAKIR:
That is because Allah is the Protector of those who
believe, and because the unbelievers shall have no protector
for them.YUSUFALI:
And how many cities, with more power than thy city which has
driven thee out, have We destroyed (for their sins)?PICKTHAL:
And how many a township stronger than thy township (O
Muhammad) which hath cast thee out, have We destroyed, and they had no
helper!SHAKIR:
And how many a town which was far more powerful than the
town of yours which has driven you out: We destroyed them so
there was no helper for them.YUSUFALI:
Is then one who is on a clear (Path) from his Lord, no better
than one to whom the evil of his conduct seems pleasing, and such as follow
their own lusts?PICKTHAL:
Is he who relieth on a clear proof from his Lord like those
for whom the evil that they do is beautified while they follow their own
lusts?In it there are for them all kinds of
fruits; and Grace from their Lord.Can those in such Bliss) be compared to
such as shall dwell for ever in the Fire, and be given, to drink, boiling
water, so that it cuts up their bowels (to pieces)?Are those who enjoy all this) like
those who are immortal in the Fire and are given boiling water to drink so
that it teareth their bowels?Are these) like
those who abide in the fire and who are made to drink
boiling water so it rends their bowels asunder.YUSUFALI:
And among them are men who listen to thee, but in the end,
when they go out from thee, they say to those who have received Knowledge,
"What is it he said just then?"Those are they whose
hearts Allah hath sealed, and they follow their own lusts.These are they upon whose hearts Allah has set a seal
and they follow their low desires.YUSUFALI:
But to those who receive Guidance, He increases the (light of)
Guidance, and bestows on them their Piety and Restraint (from evil).PICKTHAL:
While as for those who walk aright, He addeth to their
guidance, and giveth them their protection (against evil).SHAKIR:
And (as for) those who follow the right direction, He
increases them in guidance and gives them their guarding
(against evil).But already have come some tokens thereof, and when it
(actually) is on them, how can they benefit then by their admonition?PICKTHAL:
Await they aught save the Hour, that it should come upon them
unawares?YUSUFALI:
Know, therefore, that there is no god but Allah, and ask
forgiveness for thy fault, and for the men and women who believe: for Allah
knows how ye move about and how ye dwell in your homes.Allah knows the place of your returning
and the place of your abiding.YUSUFALI:
Those who believe say, "Why is not a sura sent down (for us)?"But when a sura of basic or categorical meaning is revealed, and fighting
is mentioned therein, thou wilt see those in whose hearts is a disease
looking at thee with a look of one in swoon at the approach of death.PICKTHAL:
And those who believe say: If only a surah were revealed!But
when a decisive surah is revealed and war is mentioned therein, thou seest
those in whose hearts is a disease looking at thee with the look of men
fainting unto death.SHAKIR:
And those who believe say: Why has not a chapter been
revealed?But when a decisive chapter is revealed, and
fighting is mentioned therein you see those in whose hearts
is a disease look to you with the look of one fainting
because of death.PICKTHAL:
Would ye then, if ye were given the command, work corruption
in the land and sever your ties of kinship?SHAKIR:
But if you held command, you were sure to make mischief
in the land and cut off the ties of kinship!SHAKIR:
Those it is whom Allah has cursed so He has made them
deaf and blinded their eyes.YUSUFALI:
Do they not then earnestly seek to understand the Qur'an, or
are their hearts locked up by them?PICKTHAL:
Will they then not meditate on the Qur'an, or are there locks
on the hearts?Nay, on the
hearts there are locks.Evil One has instigated them and busied them up with
false hopes.SHAKIR:
Surely (as for) those who return on their backs after
that guidance has become manifest to them, the Shaitan has
made it a light matter to them; and He gives them respite.Allah knoweth their secret
talk.He made their deeds of no
effect.SHAKIR:
That is because they follow what is displeasing to Allah
and are averse to His pleasure, therefore He has made null
their deeds.YUSUFALI:
Or do those in whose hearts is a disease, think that Allah will
not bring to light all their rancour?SHAKIR:
Or do those in whose hearts is a disease think that
Allah will not bring forth their spite?YUSUFALI:
Had We so wiled, We could have shown them up to thee, and thou
shouldst have known them by their marks: but surely thou wilt know them by
the tone of their speech!And thou shalt know
them by the burden of their talk.PICKTHAL:
And verily We shall try you till We know those of you who
strive hard (for the cause of Allah) and the steadfast, and till We test
your record.Allah and
oppose the messenger after the guidance hath been manifested unto them,
they hurt Allah not a jot, and He will make their actions fruitless.YUSUFALI:
O ye who believe!PICKTHAL:
O ye who believe!SHAKIR:
O you who believe!Allah will not forgive them.SHAKIR:
Surely those who disbelieve and turn away from Allah's
way, then they die while they are unbelievers, Allah will by
no means forgive them.Allah is with you, and will never put you in loss
for your (good) deeds.PICKTHAL:
So do not falter and cry out for peace when ye (will be) the
uppermost, and Allah is with you, and He will not grudge (the reward of)
your actions.SHAKIR:
And be not slack so as to cry for peace and you have the
upper hand, and Allah is with you, and He will not bring
your deeds to naught.YUSUFALI:
The life of this world is but play and amusement: and if ye
believe and guard against Evil, He will grant you your recompense, and will
not ask you (to give up) your possessions.And if ye
believe and ward off (evil).He will give you your wages, and will not ask
of you your wordly wealth.PICKTHAL:
If He should ask it of you and importune you, ye would hoard
it, and He would bring to light your (secret) hates.SHAKIR:
If He should ask you for it and urge you, you will be
niggardly, and He will bring forth your malice.YUSUFALI:
Behold, ye are those invited to spend (of your substance) in
the Way of Allah: But among you are some that are niggardly.But Allah is free of all
wants, and it is ye that are needy.Allah,
yet among you there are some who hoard.Him), and if
you turn back He will bring in your place another people,
then they will not be like you.
