high English usage. We care that you can write clearly.TOP 10 SIGNS OF BAD LEGAL WRITING 10.Look for sentences or phrases starting with "it is" or "it was.""The documents were mysteriously destroyed."Morris, a case involving a similar traffic accident, held that a person riding a bicycle must adhere to the same standards as a person driving a car, although it limited its holding to the facts of that case, which included the fact that the bicyclist was intoxicated.GOOD WRITERS USE SEVERAL SHORT SENTENCES "Chester v.BAD LEGAL WRITERS USE MEANINGLESS ADVERBS THINKING THEY MAKE AN ARGUMENT STRONGER Chester v.Morris clearly held that bicyclists must adhere to the rules of the road.GOOD WRITERS DILIGENTLY AVOID USELESS ADVERBS Chester v.The fact that he was drunk is important The holding is narrow. It is important that he was not wearing a helmet. It is obvious that drunken bicyclists are dangerous.Morris was decided before the statute was amended.""In fact, he should be commended.""During the course of his ride, he never fell off his bicycle" "It has been determined that he was wearing his helmet.""It is obvious that a drunken bicyclist is a danger on crowded streets.""It is clear that he had the right of way.He was clearly justified in crossing the street" "Chester v.Morris is distinguishable (or worse, clearly distinguishable)."Evidence that the defendant was drunk does not remove the issue of contributory negligence" "Despite the defendant's drunkenness, he operated his bicycle carefully.""During his ride, he never fell off his bicycle" "He was wearing his helmet.""He had the right of way.It is interesting to note ...Alternatives can come from current news stories, interesting cases, common experience or your personal experience. In litigation, alternatives are often defined by the two sides of the case. This case presents the issue of whether a physician should be exempt from jury duty.On the other hand, we have a historical principle of universal jury service. You should state the best plausible case for your side and the worst plausible case for the other side, but both sides must be plausible. The state argues that Dr.Jones should be exempt from jury duty because he is a surgeon and has patients waiting. In the absence of information, choices can only be made on the basis of personal biases, stereotypes and prejudices.Whether you are writing in a neutral or an advocacy style, you want your conclusion to appear to be reasoned rather than based purely on bias.Such information is of three kinds: facts, legal authority, and social authority.Neutral writing must summarize the information favoring each alternative. There are no cases in Indiana on this issue, although cases concerning other exemptions have held that the matter is generally within the discretion of the General Assembly.Thirty other states have statutes specifically exempting doctors; twenty do not.Any blanket occupational exemptions must be justified by a compelling state interest, although individual decisions to excuse someone from jury service are within the trial judge's discretion.Against this background are several studies by social psychologists showing that juries without educated elite jurors such as physicians produce different verdicts than juries on which educated jurors participate. In advocacy writing, the summary of relevant information should be slanted to favor your side. Two examples (very abbreviated): For the state: Court records indicate that the issue has come up in Bloomington rarely in the last five years and that not all physicians are excused.Indiana practice of exempting doctors, and the practice has been approved by a majority of state courts. The Court has not previously ruled on the issue of physician exemptions, but has said clearly that the trial judge's decision in an individual case is within discretion. The issue has not been specifically addressed by the social psychologists who study jury behavior. For the defense: Court records indicate that in every Bloomington case in the last five years a physician who invoked the exemption was excused from jury duty. There are no cases in Indiana on this issue, and other states are divided on the wisdom of creating a blanket physician exemption.Did a witness have an adequate opportunity to observe? Is a case cited in a brief recent or old, from this or a different jurisdiction, from a lower or higher court, a majority opinion or a split decision?Does an expert have appropriate education and training, adequate experience, a bias or vested interest, good institutional affiliations?Has a case been cited approvingly or criticized by other judges, in treatises, or in law review articles? Is a witness's opinion supported by adequate personal observations? If no alternative is clearly better than any other, the better solution may be a compromise. The alternative you ultimately select is not necessarily the one that "wins" the critical analysis.Legal decisionmaking is not mathematical, and no judge or lawyer would weigh all issues equally. For example, some judges place great weight on the single principle of how widely held a particular legal doctrine is, or adheres to precedent for the sake of stability in the law, even if the reform alternative has the better of most of the analysis. However, a good judge first expresses some concern about the result, given that his or her analysis of other factors suggests that the majority may be wrong.Odd for me to say something positive about Silverlight. After reading Scott Guthrie's blog entry about Silverlight 2.Frankly, out of the box Flex looks pretty lousy next to it.Odd to see a Microsoft product that's graphically more pleasing than something from Adobe.Comments (Comment Moderation is enabled.I've dismissed Silverlight after seeing v1.You can tell that no designers were involved in Scotts app though. The thing looked horrible in its completeness, though individual parts (the button) looked good in stock settings.Enter your email address to subscribe to the Firemoss blog.BlogCFC was created by Raymond Camden. This blog is running version 5.French Webisode 2: The Good Dr.The immune system is designed to protect against microscopic organisms and foreign substances that enter from outside the body and against some cancer cells that arise within....In terms of the immune system, they should have knowledge that there are specialized cells and molecules which identify and destroy microbes inside and outside of the body. For example, by the end of high school, students should know that the nervous system works via electrochemical signals in the nerves and that these signals are transferred from one nerve to the next.By the end of high school, students should understand the following three concepts about human health.First, they should know that communication between the cells of different systems is required to coordinate diverse activities. It is thus reasonable for them to deduce that one system may have an effect on another system. The Laughing Brain 2: A Good Laugh focuses on three concepts.Laughter is the result of our finding something humorous.Laughter appears to benefit our mental health to such a degree that even mental health professionals suggest incorporating "laughter therapy" as a method in helping people cope with difficult life situations. The science of studying the benefits of laughter to our immune system is termed psychoneuroimmunology. Then ask students to suggest what factors they feel can affect what one finds humorous. Some examples are: personality, intelligence, mental state, upbringing, age, and mood.Did everyone laugh at the same jokes? The fist part of the lesson is devoted to an exploration of the various theories of laughter. What are the three theories about what we find humorous? They are the incongruity theory, superiority theory, and relief theory. What is the basis for the incongruity theory? What is the superiority theory?Humor arises when we laugh at a joke that focuses on someone else's mistakes, stupidity, or misfortune.Humor occurs when tension or suspense is built up and then comic relief is used to break it down.Which theory is used by the film industry?Recap with students that various sensations and thoughts trigger laughter and its associated responses.Introduce this part of the lesson by telling students that from the Laughing Brain 1, we know that laughter is important to our social, mental, and physical health.Sheet, have students read Laughter and Health, from How Stuff Works. What are some of the effects that laughter can have on the human body? The next part of the lesson addresses psychoneuroimmunology (the science of studying the benefits of laughter to our immune system).Psychoneuroimmunology studies the interactions between which parts of your body? What does bad stress do to your immune system? It is bad because a suppressed immune system leaves you more receptive to disease.Sheet, students should prepare a report on laughter and the immune system. They can work in small groups or pairs to prepare a project called How Laughter Benefits Your Immune System.Urge students to be creative in their presentations. This could help them for future writing assignments. This will bring up an abstract entitled "Seriously, laughter matters."The above search is very limited; you can show them that if you type in just psychoneuroimmunolgy, you will get hundreds of matching abstracts to this search. All lyrics on oneself; is it possible that, even though Snape may have been acting on the side of good, that he may still be considered a murderer by the Wizarding World?Tune in to find out what we think, and he repented.BTW, we read your last comment.Thank you so much for it.Keep an ear out for our Halloween podcast, by the way!Harry and getting Malfoy out of his vow, but I was thinking more strategically.Dumbledore felt he could defeat him.Snape out of the Unbreakable vow, I think there is even more of a reason for this.Harry so well during HBP .Snape was giving Harry tips after Dumbledore was killed).Sneered Snape, deflecting the curse once more.Blood Prince, Page 603, U.It sounds to me like Snape is trying to teach Harry an important lesson. Thanks again for yet another great show!!Crouch is definately the one who is most faithful to Voldemort.Karakoff was the one running to Snape all school year freaking out about the dark mark.If not, then he is the one who was killed and therefore Snape is considered the most faithful servant.Just that is what Voldemort thinks.Woops, not that it makes a difference but I wrote the last comment, not Greg (for some reason, he was logged in on my computer).Alan Rickman as Severus Snape.Your comments about him being too old to play Snape may be accurate technically, but to me he personifies Snape.Of all the movie characters, he was such an immediate fit for me that when I read the books I see his face and hear his voice. All that is needed to prove all conspiracies wrong is just how complicated they would make the story.Harry still has to find all of the other Horcruxes, and destroy them, then battle Voldemort himself.Good Morning America (Lucas Grabeel was MIA).UPDATE: After being asked that question and right before the commercial break, Zac smiles, approaches Vanessa and holds up one finger. You can watch it here but it seems bogus since you never actually SEE her say yes.September 2007High School Musical 2: Got Milk? That would be so sweet if it was really true.Yeah, I bet Vanessa want to get in his pants!Maybe the one he was pointing him was to go along with the song.THEY HAVE MATCHING PRAYER
